These Terms and Conditions (“Terms”) apply to your use of www.scottanddaughters.com and to purchases made through our website.

By accessing our website, creating an account, or placing an order with us, you agree to these Terms together with any policies referred to in them, including our Shipping Policy, Returns & Refunds Policy and Privacy Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Scott and Daughters is an overseas business that offers products directly to customers in Australia.

Where the Australian Consumer Law applies to a transaction, nothing in these Terms excludes, restricts or modifies any rights or remedies available to Australian consumers under that law.


2. ONLINE STORE TERMS

By using this website, you confirm that you are at least the age of majority in your place of residence or that you have the consent of a parent or legal guardian to use the website.

You must not use our website, products or services for any unlawful or unauthorised purpose.

You must not transmit viruses, malware, destructive code or any other material designed to interfere with the operation or security of our website or services.

We may suspend or restrict access to the website where we reasonably believe these Terms have been breached or where this is necessary to protect our customers, business or systems.


3. PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, measurements, colours, photographs, materials, specifications and other information displayed on our website are accurate.

However:

  • colours may appear slightly different depending on your device, screen settings and lighting;

  • minor manufacturing variations may occur between production batches;

  • measurements may contain reasonable tolerances where stated on the relevant product page; and

  • styling items or accessories shown in photographs are not included unless expressly stated in the product description.

Product images are intended to provide a reasonable representation of the item.

Nothing in this section limits your rights where a product is materially different from its description, does not correspond with representations made about it, is not of acceptable quality, or otherwise fails to comply with an applicable consumer guarantee.

We may update product descriptions, specifications and availability from time to time. Changes will not retrospectively alter the product you agreed to purchase.


4. PRODUCT AVAILABILITY

All orders are subject to product availability.

We may use third-party suppliers, warehouses and fulfilment partners to process and ship orders. Some products may be dispatched directly by a supplier or fulfilment facility, including facilities located outside Australia.

Where relevant, information about international fulfilment and expected delivery timeframes will be provided through our website or Shipping Policy.

If, after you place an order, we discover that an item is unavailable, we will contact you as soon as reasonably practicable.

Where we cannot supply an item you have paid for, we will offer an appropriate solution, which may include a replacement, alternative product or refund, depending on the circumstances and your rights under applicable law.


5. PRICING

Unless otherwise stated, prices shown to Australian customers are displayed in Australian dollars (AUD).

The total price presented to you before completing your purchase will include taxes, duties, charges and other amounts that we are required by law to include in the displayed total price.

Any applicable delivery charges or optional charges will be disclosed before you submit your order.

Where charges imposed separately by customs authorities, carriers or other third parties may apply and cannot reasonably be included in the purchase price, we will provide relevant information where required by law.

Prices may change from time to time. A price change will not affect an order already accepted at the agreed price, except where there has been an obvious pricing error and applicable law permits us to correct it.


6. PRICING AND LISTING ERRORS

Despite our reasonable efforts, a product may occasionally be listed with an incorrect:

  • price;

  • description;

  • promotion;

  • availability status;

  • shipping charge; or

  • other product information.

Where an obvious error occurs, we may contact you before fulfilling the order to explain the issue and offer you the opportunity to proceed on the corrected basis where appropriate.

If we cannot fulfil the order as placed because of an error, we may cancel the affected item or order and refund any amount already paid for that item or order.

Nothing in this section allows us to engage in misleading or deceptive pricing practices or otherwise restrict your rights under applicable law.


7. PLACING AN ORDER

When placing an order, you agree to provide accurate, current and complete information.

This includes your:

  • name;

  • email address;

  • billing information;

  • shipping address; and

  • payment information.

Please carefully review your information before submitting your order.

After placing an order, you will normally receive an order confirmation by email.

We may need to conduct additional checks before processing an order, including checks relating to:

  • payment authorisation;

  • stock availability;

  • address information;

  • suspected fraud or unauthorised payment activity;

  • unusual order activity; or

  • an obvious pricing or listing error.


8. REFUSAL OR CANCELLATION OF ORDERS BY US

We may refuse, limit or cancel an order where we have a reasonable basis to do so.

Examples include:

  • payment being declined or not authorised;

  • incorrect or incomplete customer information;

  • suspected fraudulent or unauthorised activity;

  • product availability issues;

  • an obvious pricing or listing error;

  • restrictions on delivery to a particular location; or

  • unusual purchasing activity that reasonably requires verification.

Where we cancel an order after payment has been received, we will refund the relevant amount to the original payment method unless another method is agreed with you or required by law.

We will not cancel an order for a reason prohibited by applicable law.


9. CUSTOMER CANCELLATION REQUESTS

If you wish to cancel or change an order, please contact us as soon as possible at info@scottanddaughters.com.

Orders are sent to our fulfilment process shortly after being placed. We will make reasonable efforts to accommodate cancellation or amendment requests where operationally possible.

However, once an order has entered advanced processing, been packed or been handed over for shipment, we may no longer be able to intercept or cancel the parcel.

If an order can no longer be cancelled before dispatch, you may be able to request a return after delivery in accordance with our Returns & Refunds Policy.

This section applies to voluntary cancellation requests and does not limit any cancellation, refund or other rights you may have under the Australian Consumer Law.


10. PAYMENT

We accept the payment methods displayed at checkout.

Depending on availability, these may include:

  • credit or debit card;

  • Apple Pay;

  • Google Pay;

  • Shop Pay; and

  • other payment providers displayed at checkout.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

Payment services may be provided by third-party payment processors and may also be subject to their applicable terms and privacy policies.

We do not receive or store complete card information where payment details are handled directly by an authorised payment provider.


11. SHIPPING AND DELIVERY

Shipping information, processing times and estimated delivery periods are set out in our Shipping Policy and, where applicable, on individual product pages.

Delivery dates and timeframes are estimates unless we expressly state that a particular delivery date is guaranteed.

Factors outside our direct control may occasionally affect delivery, including:

  • carrier delays;

  • customs processing;

  • severe weather;

  • peak-period congestion;

  • transportation disruptions; and

  • other unexpected logistics issues.

Where we become aware of a material delay, we will make reasonable efforts to provide accurate information about the delay and available next steps.

If an order is not delivered within an agreed timeframe or otherwise within a reasonable time, any rights or remedies available to you under applicable law remain unaffected.

International fulfilment

Some orders may be shipped directly from third-party suppliers or fulfilment centres located outside Australia.

This may mean that:

  • international tracking is used;

  • tracking scans may not appear at every stage of transit;

  • local delivery may be completed by a different carrier from the international carrier; and

  • delivery times may be longer than for domestically fulfilled orders.

Using a third-party supplier, warehouse or carrier does not remove any legal responsibility that Scott and Daughters has to you as the seller.


12. DELIVERY INFORMATION PROVIDED BY YOU

You are responsible for providing a complete and accurate delivery address.

If you realise that you have provided incorrect information, please contact us as soon as possible.

Where an order has not yet been processed, we may be able to correct the address.

Once an order has been dispatched, changes may no longer be possible.

If a parcel cannot be delivered because of incorrect or incomplete information provided by the customer, reasonable additional costs associated with redelivery or return-to-sender processing may apply where permitted by law.

This does not apply where the delivery problem was caused by an error for which Scott and Daughters is responsible.


13. RETURNS, REFUNDS AND EXCHANGES

Our voluntary return, refund and exchange procedures are set out in our Returns & Refunds Policy.

That policy forms part of these Terms.

Our voluntary return policy operates in addition to, and not instead of, your rights under the Australian Consumer Law.

Conditions that apply to a voluntary change-of-mind return, such as return timeframes, tags, hygiene seals or the condition of an item, do not remove statutory remedies that may apply where a product has a genuine problem covered by Australian Consumer Law.


14. AUSTRALIAN CONSUMER LAW

Goods supplied to Australian consumers come with consumer guarantees under the Australian Consumer Law where that law applies.

Depending on the circumstances, these guarantees may include that goods:

  • are of acceptable quality;

  • are fit for their ordinary purpose;

  • are fit for a particular purpose made known before purchase;

  • correspond with their description;

  • correspond with any applicable sample or demonstration model; and

  • comply with other applicable statutory guarantees.

If a product fails to comply with an applicable consumer guarantee, you may be entitled to a remedy.

For a major failure with goods, applicable law may entitle you to reject the goods and choose between a refund and replacement.

For a failure that is not major, we may be entitled to provide an appropriate remedy within a reasonable time.

You may also have rights in relation to reasonably foreseeable loss or damage caused by a failure to comply with a consumer guarantee.

Nothing in:

  • these Terms;

  • our Returns & Refunds Policy;

  • our Shipping Policy;

  • any warranty;

  • any product page; or

  • any customer service communication

is intended to exclude, restrict or modify a right or remedy that cannot lawfully be excluded, restricted or modified.


15. CHANGE-OF-MIND RETURNS

Australian Consumer Law does not generally require a retailer to provide a refund simply because a customer changes their mind.

Scott and Daughters nevertheless offers a voluntary change-of-mind return policy subject to the conditions set out in our Returns & Refunds Policy.

Where a return is purely for change of mind, applicable return shipping costs may be the customer's responsibility as explained in that policy.

Different rules may apply where an item is faulty, damaged, incorrectly supplied, materially different from its description or otherwise subject to a consumer guarantee claim.


16. PROMOTIONS, DISCOUNTS AND STORE CREDIT

Promotional offers, discount codes and store credits may be subject to additional terms displayed with the relevant offer.

Unless otherwise stated:

  • discount codes cannot be exchanged for cash;

  • only one discount code may be used per order;

  • promotions may have an expiry date;

  • a promotion may apply only to selected products;

  • store credit may be subject to separate conditions disclosed when it is issued; and

  • promotions cannot be applied retrospectively to completed orders.

We may withdraw or amend a promotion before an order is placed where there is a reasonable commercial reason to do so.

Any change will not retrospectively remove a promotional benefit that has already formed part of a completed purchase.


17. ACCOUNT INFORMATION AND SECURITY

If you create an account with us, you are responsible for keeping your login details confidential and secure.

You agree to provide and maintain accurate account information.

Please notify us promptly if you believe your account has been accessed without authorisation.

We may temporarily restrict an account where reasonably necessary to investigate suspected fraud, security issues or misuse.


18. INTELLECTUAL PROPERTY

Unless otherwise stated, the content made available through our website belongs to Scott and Daughters or is used by us with permission.

This may include:

  • text;

  • photographs;

  • graphics;

  • branding;

  • logos;

  • product descriptions;

  • video;

  • website design; and

  • other content.

You may access and use the website for personal, non-commercial shopping purposes.

You must not reproduce, publish, distribute, sell, commercially exploit or create derivative works from our website content without our prior written permission, except where permitted by law.

Nothing in these Terms limits rights that cannot lawfully be restricted.


19. REVIEWS, FEEDBACK AND USER CONTENT

If you voluntarily submit a review, photograph, feedback, comment or other content to us, you confirm that:

  • you have the right to submit it;

  • it is not knowingly false or misleading;

  • it does not unlawfully infringe the rights of another person; and

  • it does not contain unlawful or malicious material.

You retain ownership of content you create.

By submitting content for publication or promotional use, you grant Scott and Daughters a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, edit and publish that content for purposes reasonably connected with operating, marketing and promoting our business and services.

We may moderate or remove user content where we reasonably believe it is unlawful, fraudulent, abusive, infringing or otherwise inappropriate.

We will not manipulate or suppress reviews in a manner that creates a misleading overall impression of customer feedback.


20. PROHIBITED USE

You must not use our website:

  1. for an unlawful or fraudulent purpose;

  2. to violate applicable laws or regulations;

  3. to infringe intellectual property or privacy rights;

  4. to upload or distribute viruses, malware or other harmful code;

  5. to collect or scrape personal information without lawful authority;

We aim to keep our website available and functioning correctly, but we do not guarantee uninterrupted access at all times.

Access may occasionally be interrupted because of:

  • security updates;

  • technical problems;

  • network failures; or

  • circumstances outside our reasonable control.

We may update or modify website functionality from time to time.

Nothing in this section affects an existing order or any statutory rights arising from a purchase.


23. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies:

  • the Australian Consumer Law;

  • consumer guarantees;

  • rights to compensation for reasonably foreseeable loss or damage where applicable; or

  • any other liability that cannot lawfully be excluded or limited.

Subject to those rights, and to the maximum extent permitted by law, Scott and Daughters will not be liable for loss that:

  • was not reasonably foreseeable at the time of the transaction;

  • was caused by your unlawful or improper use of the website or product;

  • arose from information you knowingly provided incorrectly; or

  • results solely from circumstances for which we are not legally responsible.

Any limitation of liability in these Terms applies only to the extent permitted by applicable law.


24. INDEMNITY

To the extent permitted by law, you agree to indemnify Scott and Daughters against reasonable losses, liabilities or costs directly resulting from:

  • your unlawful use of our website;

  • your intentional infringement of a third party's rights; or

  • a deliberate and material breach of these Terms.

This indemnity applies only to the extent that the relevant loss was caused by your conduct.

It does not apply to losses caused by Scott and Daughters, our breach of law, or matters for which liability cannot lawfully be excluded or transferred to you.


25. PRIVACY

We handle personal information in accordance with our Privacy Policy and applicable privacy laws.

Please review our Privacy Policy for information about how we collect, use, disclose and protect personal information.


26. SUSPENSION AND TERMINATION

You may stop using our website at any time.

We may suspend or terminate access to an account or website functionality where we reasonably believe:

  • these Terms have been materially breached;

  • fraudulent or unlawful conduct has occurred;

  • there is a genuine security risk; or

  • suspension is otherwise reasonably necessary to protect our customers or systems.

Termination or suspension does not remove rights or obligations relating to orders already placed, refunds due, consumer guarantees or liabilities that arose before termination.


27. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or severed only to the extent necessary.

The remaining provisions will continue to apply to the extent legally possible.


28. NO WAIVER

If we do not immediately exercise a right available to us under these Terms, that does not automatically mean we have waived that right.

Similarly, nothing in these Terms prevents you from exercising a statutory right available to you.


29. ENTIRE AGREEMENT

These Terms, together with the policies expressly incorporated into them, set out the terms governing your use of our website and purchases from us.

They do not exclude:

  • rights arising under applicable consumer law;

  • representations that cannot lawfully be excluded; or

  • any separate written agreement expressly entered into between you and Scott and Daughters.

If a specific written agreement between you and us conflicts with these Terms, the specific agreement will apply to the extent of the conflict, subject to applicable law.


30. CHANGES TO THESE TERMS

We may update these Terms from time to time, including to reflect changes to:

  • our services;

  • our business processes;

  • applicable laws; or

  • website functionality.

The most recent version will be published on this page together with its effective date.

Unless required by law, changes will apply prospectively and will not retrospectively alter the contractual terms applying to an order already placed.

Your continued use of the website after updated Terms take effect means the updated Terms will apply to your subsequent use of the website and future orders.


31. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States of America, except to the extent that mandatory laws in another jurisdiction apply to a particular transaction.

For customers in Australia, nothing in this governing law provision excludes, restricts or modifies the application of the Australian Consumer Law or any other mandatory Australian consumer protection rights that apply to the transaction.

Where Australian Consumer Law applies, those statutory rights remain available regardless of the governing law specified in these Terms.
